From Planning Resource: http://www.planningresource.co.uk/article/1228310/pickles-backs-tower-hamlets-free-school

'The communities secretary has overruled a London borough's rejection of plans for a free school after concluding that concerns about noise, pedestrian safety and traffic congestion could be mitigated via planning conditions..

'The London Borough of Tower Hamlets had rejected the application... against officers’ advice... (over) health and safety issues, congestion and noise and vibration from a proposed roof-top play area.'

Comment from Plan-it-law: http://www.plan-it-law.com/2014/01/free-school-wins-on-appeal.html

'If any readers are promoting such developments then the decision is well worth a read for the clear weight placed on the Planning for Schools policy statement and NPPF paragraph 72. The Inspector dealt briskly with the reasons for refusal and was very clear in his view on where the evidence against had been lacking.'
